France is ready to output the state of health emergency on July 11. The constitutional Council validated Thursday the law that sets the output state of a health emergency from Saturday, but clarified the prohibitions on the movement of persons, which cannot, according to him, lead to a containment, even localized. The Parliament had definitively adopted on July 2, the draft law organizing the output of a health emergency, with possible restrictions until the fall, considered by the opposition to an extension in "trompe l'oeil" of this regime of exception.

The text allows restrictions on the movement of people, the reception of the public in certain institutions or gatherings. The constitutional Council considers that " the prohibition of movement of persons and vehicles, as well as the prohibition of access to the means of collective passenger transport can not be laid down that in territories where an active circulation of the virus has been found ". And he considers that " the prohibition of movement of persons can only lead to deny them out of their home or its surroundings ", according to the ruling seen by Agence France-Presse.

Put in place since the 17 march

During the debate in the Parliament, the Senate had sought in the first reading to be " constructive ", by reducing the scope of possible restrictions. But the deputies were then reintroduced the possibility to prohibit the movement or order the temporary closure of schools in some parts of the territory in which is found an active circulation of the virus. For the minister of Health, Olivier Véran, the bulk of the state health emergency " disappears ", but " not to keep certain measures, it would be as if the risk of a restart (of the epidemic) did not exist ". If it were necessary to decide whether a new containment, such as the one in place from the 17 march, the government should again declare a state health emergency.
