A majority in the Danish Parliament declares itself ready to look at the possibility of rolling some of the elements of the new divorce law, which was introduced pr. 1. april of this year, back.
It is both pleasing and sensible.
This concerns especially the so-called period of reflection, which replaces the former option for a ‘lynskilsmisse’, where the situation was fixed with a snap and a NemID card, if both parties agree.
this reflection period will stretch over three months, and during that period couples who want to be divorced, take a test and a digital course, if they have common children. Fail or refuse, they can not be separated.
It is no wonder that the kind of paternalistic requirement has caused fierce criticism. Several points, actually, that this reflection period will counterproductive can step up skilsmissekonflikter.
It is however strange that there was a desire to mix the state deeper into the adult human own decisions. Such a radical intervention in families ' personal and private matters are no places at home.
It was the former government that, in cooperation with all parties in the Danish Parliament agreed on the new family law system, even though it wasn't all parties, who expressed equal enthusiasm for all the elements. Precisely this reflection period will were a bone of contention, which all, however, finally agreed to.
That the man already half a year after the law's introduction declares itself ready to change it again to the witnesses about how senseless it was to introduce it in the first place.
No introducing, of course, rules to be evil, and the idea of the new law was to take the utmost account of the children who are the weaker party in most divorces.
There, where the chain jumps of, is when you think that the politicians 'ideas and effectively management can outperform the parents' natural care of their own children.
It is in its place, that there is a system, which can be a safety net for the children in cases where parents cannot resolve their conflicts, but the starting point must be that the highest possible number of decisions are taken by the families themselves.
No one is probably married only to be divorced again, and marriage is of course not something you should jump into and out of without thinking about. But it can easily be done without public rules on how and how long it should take.
the Family is a fundamental element in our society, and today one can happily continue to be family, even though father and mother are not married to each other.
Family ties can be stronger than marriage, and parents ' evaluations as a starting point weights higher than the intricate requirements of a public being.Jonas Kuld Rathje chief Editor
