Former US Vice President Mike Pence wants to take legal action against his subpoena in the investigation of his former boss Donald Trump. Pence announced yesterday that he would go as far as the Supreme Court if necessary. Pence was subpoenaed by the Justice Department's special counsel investigating Trump for his role in the Jan. 6, 2021 storming of the Capitol.

Pence said such a subpoena violated the US Constitution. No vice president has ever been subpoenaed to testify against a president he served with, Pence said. He enjoys immunity because of his role as President of the Senate, which US Vice Presidents automatically hold under the Constitution.

Will Pence stand in the 2024 election?

On January 6, 2021, Pence, in his role as President of the Senate, was tasked with formally confirming the result of the presidential election that Trump lost. Supporters stormed the parliament seat to stop the proceedings. Trump had previously openly called on his deputy to block confirmation of the election.

Pence served as Vice President Trump from 2017 to 2021. It's widely believed that Pence wants to run as the Republican presidential candidate in the 2024 election. However, he would first have to assert himself in the internal party primaries against Trump, who has already announced his candidacy.
