It happened in October 2018, when a man contacted a clinic in Barcelona to have a hair implant. He was treated by a doctor, and he told her that he was a carrier of the acquired immunodeficiency virus (HIV) and that he was regularly receiving treatment, his viral load being undetectable.

Said doctor transferred the information to those responsible for the company Clínica Estética E S.L, based in Malaga, and both, without carrying out any verification or study of the patient, refused to perform the graft. They communicated it with an email, in which without any further details, they alleged "company policy".

Now, the Barcelona Prosecutor for Hate Crimes and Discrimination asks to disqualify for three years two individuals responsible for the business, F.J.R.S.

and V.R.S, one of them optional, as well as compensation of 2,500 euros for the affected person, considering that the implant "did not entail any added risk compared to those that may occur in the general population". Neither for the patient himself, nor for the doctors, Miguel Ángel Aguilar points out in his writing.

In addition, the Public Ministry, which accuses them of committing a crime against fundamental rights, considers that the doctor who treated the patient in Barcelona did not participate decisively in said decision, as she herself stated during her statement in the court of instruction.
