The activist Roger Español, who lost an eye due to the impact of a rubber ball on 1-O, and four agents of the National Police, have been one step away from trial for their actions during the illegal referendum. The first, for launching, at least, a fence against the uniformed men, in the vicinity of a voting center on Sardeña street in Barcelona. The policemen, due to injuries, after the complaints of thirteen people -among which the Spaniard himself is included-.

In a car, the head of the Court of Instruction 7 of the Catalan capital details that the officials who will have to sit on the bench are the one who fired the projectile that caused the injury to Español, "in breach of the security measures" contemplated in the circular on the use of riot gear; as well as the person most responsible for said action.

Judge Francisco Miralles maintains that he "was the first to use police defense against people sitting on the ground, thus ordering its use by his subordinates." He was also the one who gave the order to launch the rubber balls "outside the assumptions" provided for by the Corps' internal regulations.

As for the two remaining policemen, they will have to go to trial for hitting protesters who were sitting on the ground with the baton, which would also mean breaking the regulations regarding its use.
