The defense had not considered the allegation of intentional attempted homicide to be proven in its plea and argued that all other allegations had already been settled with the 13 months in custody. His client fled from the police in fear of death and accidentally hit the police officer. The federal prosecutor's office, on the other hand, had demanded ten years in prison for attempted murder for the 62-year-old, the co-plaintiff a prison sentence "in the double-digit range".
