The complainants want this judgment to be reviewed in Karlsruhe. There were many problems with the elections for the House of Representatives and the district assemblies in Berlin on September 26, 2021. Ballot papers were missing, polling stations were temporarily closed or stayed open longer, and long queues formed in front of many. The date for the re-election was set for February 12.

The Bundestag elections, which took place at the same time, are also to be partially repeated in Berlin. That was decided by the Bundestag. However, there is no date for this yet, and a constitutional complaint has also been lodged against the Bundestag decision. The Federal Constitutional Court will not decide on this on Tuesday.
