The Civil and Criminal Chamber of the Superior Court of Justice of Castilla y León has confirmed the sentence of 14 years in prison imposed by the Valladolid Provincial Court on a man of Bolivian nationality, a resident of Valladolid, for a continued crime of sexual abuse with penetration of his alleged nine-year-old daughter, whom he left pregnant on three occasions that ended in abortions performed in a clinic in the capital.

The events date back to August 2010 when the victim, a nine-year-old Bolivian minor, arrived in Spain with a temporary residence permit for reunification and began to reside with her supposed legal parents, although in reality she was the sister of the person legally like mother.

Since then, her legal and now convicted father began to have regular sexual relations with her with vaginal penetration against her will. The events, according to the judgment of the Court, occurred in her family home, taking advantage of the fact that the rest of the family was not in the house.

As a result of these relationships, the girl became pregnant three times by the defendant, although he took her to a clinic for an abortion, alleging that the pregnancies had been caused by an alleged boyfriend. Thus, the convicted person signed the informed consent for the performance of the three abortions performed on November 27, 2014, with 18 weeks of gestation, when the minor was 13 years old; on September 9, 2016, with 14 weeks of gestation when the minor was 15; and the third, on August 3, 2017, with six weeks of gestation, when the minor was 15 years old.

In addition, the ruling highlights that the legal mother of the minor and wife of the accused did not know anything about the pregnancies or the abortions performed. Finally, in a tutoring session in May 2021, the victim acknowledged the facts and told the tutor that her father had abused her for years, which led to the minor filing the complaint in May 2021.
